It’s important, too, because Arizona is only one of fourteen states that have some sort of anti-deficiency exemption when there is a potential foreclosure or short sale. Another aspect of the Arizona anti-deficiency statute that is commonly misunderstood, not only by people, but by the banks as well, is the fact that it also protects investors and investment properties. A lot of banks think that if it’s an investment property, the statute doesn’t apply and this is not the case. Several years ago, the state government tried to get it passed through the legislature to not have the anti-deficiency statute cover investors, but they were not successful in getting it passed.
